This page contains the terms and conditions on which we will supply the products (products) listed on our website www.mydukandietshop.co.uk (our site) to you.
These terms include some provisions (at section “Our Liability”) that limit our liability to you in the event that we break any of the terms of our contract with you.
Please read these terms and conditions carefully before ordering any products from our site. By placing an order for any of our products, you agree to be bound by these terms and conditions.
www.mydukandietshop.co.uk is a site operated by Medecine et Tradition (we, us, our). We are registered in France under company number B 499 668 556 and with our registered office at 128 rue de la Boétie - 75008 Paris. Our VAT number is FR 44494756109.
Our site is only intended for use by people resident in the United Kingdom. However, we accept orders from individuals outside those countries. We only accept orders from individuals who are not buying our products in relating to their trade, profession or business. We only sell to final consumers.
We do not accept orders from anyone below 18 years of age.
By placing an order through our site you confirm that you are resident in the United Kingdom and that you are at least 18 years old.
No contract will exist between you and us until we have received full payment from you and have either (i) given you a written/emailed acceptance of your order or (ii) dispatched the ordered products, whichever is the sooner. Please note that our initial acknowledgement of your order does not constitute acceptance of that order unless we expressly state otherwise.
We make every effort to ensure that sufficient products are available in stock to meet your order. However, occasionally we may find that stock is unavailable.
If we cannot deliver the products you have ordered within 30 days of your order, we will contact you and ask how you wish to proceed. You may cancel your order for a full refund (including delivery charges), await the arrival of the product in stock (unless we inform you that the product will not be coming back into stock) or change your order to replace the product originally ordered with an alternative product (with a corresponding adjustment in the price).
We aim to despatch all orders within 48 hours (Monday to Friday) and within 72 hours during busy periods. You should receive notification by email that your order has been received and once it has been despatched. Please ensure our email address is added to your ‘safe list’ and not filtered by spam/junk filters.
You can follow the packing and shipping stages of your order by clicking on the “History & details of your orders” tab in the “Managing my account” section on our site. This enables you to access details of your order.
Delivery costs are rated on order’s weight basis. Please find detailed information about prices and shipping times in Delivery conditions section.
The price of any products will be as quoted on our site. These prices include VAT but exclude delivery costs, which will be added to the total amount due.
Our site contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. If your order for purchase is not for whatever reason showing the correct price for the goods, we will inform you that the price is incorrect and advise you of what action needs to be taken. We reserve the right to reject your offer to purchase the products in these circumstances.
We accept payment by bank cards, being Visa and MasterCard, and by Paypal. An order made by bank card will be debited immediately by our bank.
By confirming you order with us you guarantee to us that you have all authorisations to use the payment method you have chosen.
You have the right to cancel any order by giving us notice of cancellation at any time up to 7 working days (Weekends and bank holidays excluded) after delivery.
If you wish to exercise your right to cancel, please contact us as soon as possible. You can contact us either by logging on to our site and going to the section “Contact us” or by telephone on 0844 338 0104 from 9am to 5pm, Monday to Friday (Bank Holidays & Weekends excluded).
Note that you must return the products to us in their original, unopened, condition and with their original packaging in accordance with our returns policy (see below). Please note that you will be responsible for the delivery costs. Please allow 30 days for any refund payments to be made. If you have paid using Paypal, we will repay any sums by Paypal system. If you have paid using any other means, we will refund any amounts using the same method as you used for payment.
We reserve the right to refuse or cancel an order without reason, with a full refund provided, as per our terms and conditions. We also reserve the right to change the requested shipping method without reason, and refund any difference in the price paid if applicable.
Examples of when we might do so include (but are not limited to):
(a) where products you have ordered are out of stock; or
(b) where we have made an error in the description or pricing of any products you have ordered;
(c) if we believe you are under 18
(d) etc.
If we decline or cancel an order we will refund all amounts paid by you in respect of that order.
If any products are damaged on arrival, then please notify this to us as soon as possible.
Please contact us to report a damaged or faulty product and return the product to us in accordance with our returns policy. On inspection of the product, if we are satisfied that the product does not confirm with there terms and conditions, we will either offer a refund, replacement or exchange. In this event we will refund to you the costs of delivering the products back to us.
Any products that are to be returned to us must be returned in accordance with our. The version of the returns policy that applies will be the version in force at the time the return is made. Failure to comply with this policy may delay processing of your return and of any refund, repair or replacement.
Whilst we take care ensure our products are displayed on our site in the same manner as the products we supply, there may be the occasion where the products description differs to that supplied. In this case please return the product to us in accordance with our returns policy.

If we break the terms of this contract, our liability for losses you suffer as a result is strictly limited to the purchase price of the product you purchased and any losses which are a foreseeable consequence of us breaking the contract. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.
These terms do not limit in any way our liability:
(a) For death or personal injury caused by our negligence;
(b) Under section 2(3) of the Consumer Protection Act 1987;
(c) For fraud or fraudulent misrepresentation; or
(d) For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
The above terms do not affect your statutory rights.
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under this contract that is caused by events outside our reasonable control.

Any contract made under these terms and conditions will be governed by English law.
