Website Terms & Conditions of Sale

This page contains the terms and conditions on which we will supply the products (products) listed on our website www.mydukandietshop.co.uk (our site) to you.

These terms include some provisions (at section Our Liability) that limit our liability to you in the event that we break any of the terms of our contract with you.

Please read these terms and conditions carefully before ordering any products from our site. By placing an order for any of our products, you agree to be bound by these terms and conditions.

 About you

Our site is only intended for use by people resident in the United Kingdom. However, we accept orders from individuals outside those countries. We only accept orders from individuals who are not buying our products in relating to their trade, profession or business. We only sell to final consumers.

We do not accept orders from anyone below 18 years of age.

By placing an order through our site you confirm that you are resident in the United Kingdom and that you are at least 18 years old.

 

How the contract is formed between you and us

No contract will exist between you and us until we have received full payment from you and have either (i) given you a written/emailed acceptance of your order or (ii) dispatched the ordered products, whichever is the sooner. Please note that our initial acknowledgement of your order does not constitute acceptance of that order unless we expressly state otherwise.

 

Product availability

Despite all the care taken by the website to supply products, an item may become unavailable between ordering and delivery. If we are unable to send all or half the order, the seller will send him a voucher equivalent to the price of the unaivalble product(s). In this case the buyer will be notified before the order is sent.

If the buyer does not accept the voucher, he may ask a refund.

In this case, the refund will be done no later than fourteen (14) calendar days from the time the buyer makes its claim.

Delivery & Postage

We aim to despatch all orders within 48 hours (Monday to Friday) and within 5 days during busy periods. You should receive notification by email that your order has been received and once it has been despatched. Please ensure our email address is added to your 'Safe list' and not filtered by spam/junk filters.

You can follow the packing and shipping stages of your order by clicking on the History and details of your orders; Managing my account; section on our site. This enables you to access details of your order.

Delivery costs are rated on order's weight basis. Please find detailed information about prices and shipping times in Delivery conditions section.

International customers will be responsible for any import duties, taxes or any other import-related costs (brokerage fees, processing fees, etc.). Also, we are not able to mark orders as 'Gifts' for customers to avoid paying these fees.

 

Prices & Payment

The price of any products will be as quoted on our site. These prices include VAT but exclude delivery costs, which will be added to the total amount due.

Our site contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. If your order for purchase is not for whatever reason showing the correct price for the goods, we will inform you that the price is incorrect and advise you of what action needs to be taken. We reserve the right to reject your offer to purchase the products in these circumstances.

We accept payment by bank cards, being Visa and MasterCard, and by Paypal. An order made by bank card will be debited immediately by our bank.

By confirming you order with us you guarantee to us that you have all authorisations to use the payment method you have chosen.


Receipt of order

-The person receiving the order

Beware, if you entrust the receipt of the product to a third party (landlord, caretaker, receptionist etc..), this person will receive the order in your name and your account.

 

You should tell the person to be particularly careful on monitoring the appropriate precautions and check the order with the conditions described below and remind him to bring the same attention as if it was personally his.

 

-Check the order

We invite you to check (or have it checked by an agent who receives the products in your name and your account) the apparent condition of the goods when delivered.

In case of apparent abnormality (damaged or missing product, damaged parcel, broken product etc..), the buyer or agent must note on the delivery order SPECIFIC ISSUES: specify the number of parcels missing and / or damaged and detailed description of possible damage (packaging opened or torned, missing or damaged product, etc..). It is essential that you keep the items in the state in which they were delivered (accessories, manuals, packagings and on packing included).

Imprecise wording, such as "subject to unpacking" or "subject to verification" are worthless. In the absence of specific issues, the Buyer acknowledges having received the right order and in good condition.

According to Article L.133-3 of the French Commercial Code, any claim for damage during the shipping and/or missing products must be confirmed by a registered letter with acknowledgment of receipt sent to the carrier within 3 days, excluding bank holidays, following the delivery.

A copy of the complaint shall be addressed by the same means to Regime Coaching.

The return will be in accordance with the terms written in the next paragraph below, Right of Retraction.

 

In any case, these precautions do not prevent the benefit of legal guarantees and the right of retraction.


Cancellations by us

We reserve the right to refuse or cancel an order without reason, with a full refund provided, as per our terms and conditions. We also reserve the right to change the requested shipping method without reason, and refund any difference in the price paid if applicable.

Examples of when we might do so include (but are not limited to):

(a) where products you have ordered are out of stock; or

(b) where we have made an error in the description or pricing of any products you have ordered;

(c) if we believe you are under 18

(d) etc.

If we decline or cancel an order we will refund all amounts paid by you in respect of that order.

 

Right of retraction

The Purchaser has, subject to the exceptions below, a period of fourteen (14) clear days from the date of receipt of the goods, to exercise the right of retraction of his order, without having to justify reasons or incurring penalties (when the period ends on a Saturday, Sunday or a bank holiday or a nonworking day, it is extended until the next business day).

This right of retraction may involve all or part of the order.

In case of exercise of right of retraction, the costs of return of the product(s) remain chargeable to the buyer.

 

To ensure the management of returns, you must first fill out a retraction form. You can also inform us, in a clear, precise and unequivocal manner, of your intention to exercise your right of retraction by any other way within the aforementioned period, especially by telephone :

A return number will be allocated to you to return the product, by email or by a registered letter with acknowledgment of receipt, assuming that: (i) you have not ordered online products and (ii) You do not have an email address.

You will have a maximum period of fourteen (14) clear days, starting the day when you sent your decision to retract to return the product to us.

 

You must ensure that the products for which you are retracting are returned in complete and perfect condition.

 

In case of exercise of right of retraction in the abovementioned conditions, the price of the purchased product(s) and the shipping costs will be refunded. Note, however, only standard deliveries proposed by the website will be refunded.

In case of simultaneous deliveries of several products and if you decide to exercise your right of retraction for only one part of the delivered products, we will refund only the shipping costs only for the products you exercise your right of retraction.

The refund will be made using the same method of payment used by the buyer for the payment of his order, within a period of fourteen (14) calendar days from the date of receipt of the returned products or from the date which you provided proof of shipping the product (s).

Beyond this period, no products will be returned, exchanged or refunded.

Exceptions to the right of retraction

In accordance with article L. 121-21-8 of the French Consumer Code, the buyer has no right of retraction when:

- Products are likely to deteriorate or expire rapidly

- Products have been opened or unsealed by the buyer after delivery.

These products will therefore not be taken by Regime Coaching.

 

Loyalty program Dukan

The loyalty program of the Dukan Shop is open to all customers who have ordered once on the online shop at the Dukan Shop.

This system allows you to accumulate points when purchasing and turning them into gifts or vouchers at the Dukan Shop:

-1 point for £4 purchase, excluding shipping.

Additional points may be awarded in exceptional occasions. Cases such as returning goods that have been purchased; the Dukan Shop will add the points corresponding to the value of the returned items.

-Points not turned into gifts after 12 months maximum, after the last attribution, will be considered as abandoned.

-Points can be turned into vouchers at the Dukan Shop. These are applicable when a customer orders. We cannot refund a voucher. Vouchers are valid for 6 months.

-Gifts or points may in no case be refunded or exchanged, changed into cash or sold or cashed in any form whatsoever.

All or part of the rules, rights and privileges set in these Terms & Conditions can be changed or deleted at any time by the Dukan Shop.

Misuse of the benefits offered by the loyalty program, any unfair practices or misbehaviour in the interest of the company, will lead the right to cancel the points or benefits that would have been obtained without compensation of any kind.


Data protection - Privacy Policy

We take your privacy very seriously. We are committed to protecting and respecting your privacy.

Regime Coaching or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.
If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms and conditions of sale and other agreements; or to protect the rights, property, or safety of Regime Coaching, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.


Access to information

We would remind you that in accordance with the provisions of articles 39 and 40 of the French Data Protection act of 6 January 1978, as amended by the act of 6 August 2004, you have the right to access and correct personal information concerning you. You can also oppose its processing for legitimate reasons. However, in the latter case, we would draw your attention to the fact that you may not or may no longer benefit from the Services.

The Data Protection Act 1998 gives you the right to access information held about you. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information we hold about you.

Our liability

Please be aware that the products on our site are designed as food supplements and not as medication. We would like to point out that none of our products are designed to replace a balanced diet. Also not all of our products are suitable for every person (for example children and pregnant women).

Please check the products description on our site carefully for further details on who should not use the supplement. We further recommend that professional medical advice should be sought before using our products.

If we break the terms of this contract, our liability for losses you suffer as a result is strictly limited to the purchase price of the product you purchased and any losses which are a foreseeable consequence of us breaking the contract. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.

These terms do not limit in any way our liability:

(a) For death or personal injury caused by our negligence;

(b) Under section2 (3) of the Consumer Protection Act 1987;

(c) For fraud or fraudulent misrepresentation; or

(d) For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

The above terms do not affect your statutory rights.

Import duties and customs

International customers will be responsible for any import duties, taxes or any other import-related costs (brokerage fees, processing fees, etc.). Also, we are not able to mark orders as 'Gifts' for customers to avoid paying these fees.

End customers are solely responsible for all import taxes, sales taxes, and any other customs-related charges. The Dukan Diet Shop accepts no liability for any such charges. Importing taxes and charges cannot and will not be quoted/predicted, and they cannot be reimbursed to you under any circumstances.


Events outside our control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under this contract that is caused by events outside our reasonable control.
